Trade union recognition is a vital aspect of industrial relations in Malaysia. A trade union registered under the Trade Unions Act 1959 [Act 262] and the Trade Unions Regulations 1959 must obtain recognition from the employer before the union can invite the employer to commence collective bargaining. The procedures and processes for a recognition claim are provided under Section 9 of the Industrial Relations Act 1967 [Act 177] and the Industrial Relations Regulations 2009 [IRR 2009] thereunder.
