Dismissal (EMS)

If you feel that you have been unfairly dismissed without just cause or excuse, you may file a representation within 60 days from the date of dismissal.

Trade Dispute (EMS)

Disputes between employers and employees involving employment and non-employment issues, terms and conditions of employment, as well as workplace rules and regulations.

Claim for Recognition (EMS)

A registered trade union must be recognized by the employer before commencing collective bargaining, enabling it to represent employees in efforts to enhance industrial relations in the workplace.

Capacity Issue (EMS)

The process of determining whether employees represented by a trade union are employed in a managerial, executive, confidential, or security capacity.

Union Busting (EMS)

The handling of complaints under Section 8 of the Industrial Relations Act 1967 involves dissatisfactions or grievances related to unfair treatment or victimization involving employers, employers' trade unions, trade union employees, or any individuals regarding the rights of employees and employers.

Sole Bargaining Rights (EMS)

Employees are required to choose only one registered trade union to represent them in collective bargaining, as only one trade union possesses the absolute right for such purposes.

Industrial Action (EMS)

A breakdown in negotiations may lead to industrial action by employees' trade unions, employers' trade unions, or employers, based on the legal requirements that must be complied with.

Strengthening Harmonious Working Relations

Industrial Harmony Index (IHI) is an instrument used to measure the level of relationship between employers and employees in Malaysia. An initiative by the Department of Industrial Relations Malaysia (DIRM), it was the first of its kind developed in Southeast Asia in 2017. The IHI measurement is based on 24 items across 5 Dimensions: Nurturing Relationships, Connectivity, Mutual Collaboration, Mutual Peace, and Responsibility.
